Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Glengarry Traditions website (the “Site”) and the purchase of products from Glengarry Traditions, a brand of Desautels Foods Inc. (“we,” “us,” or “our”), a federally inspected Canadian meat processing facility (CFIA Establishment #554) located at 20731 Concession Road 5, Green Valley, Ontario K0C 1L0. 

By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or place orders. We may update these Terms at any time; continued use constitutes acceptance of the revised Terms.

1. Eligibility and Use of the Site

• You must be at least 18 years old and a resident of Canada to place orders.
• The Site and products are for personal, non-commercial use only. Resale is strictly prohibited.
• All meat products are federally inspected under the Safe Food for Canadians Regulations (SFCR) and Food and Drugs Act.

2. Product Information and Availability

• Product descriptions, images, weights, and prices are provided in good faith but may vary slightly due to natural product differences or updates. We reserve the right to correct errors without notice.
• All products are subject to availability. We may cancel or modify orders if items are unavailable and will notify you promptly.
• Pricing is in Canadian dollars (CAD) and excludes applicable taxes and shipping, which will be shown at checkout.

3. Ordering Process

• Placing an order constitutes your offer to purchase. We may accept or reject any order at our sole discretion.
• You will receive an order confirmation email. A separate payment-request email will follow with e-transfer instructions. Our acceptance occurs only upon receipt and confirmation of full payment.

4. Payment – Interac e-Transfer Only

• We accept payment exclusively via Interac e-Transfer (an inexpensive, secure Canadian payment method).
• After order confirmation, send the exact total to the email address provided in the payment-request email admin@glengarrytraditions.ca or a dedicated address we specify).
• Include your order number in the message or security question/answer field for reference.
• Your order will not be processed or shipped until we receive and confirm full payment.
• If payment is not received within 48 hours of the payment-request email, we may cancel the order without notice.
• No refunds or credits will be issued for orders cancelled due to non-payment.
• We do not charge fees for receiving e-transfers; any sender-side fees are your responsibility.
• All payments are final once processed unless a quality issue is approved under Section 8.

5. Shipping and Delivery

• We currently ship to residential addresses in Ontario (delivery area may expand; check the Site for updates).
• Products are vacuum-sealed, flash-frozen where applicable, and shipped with sufficient dry ice or insulated packaging to maintain safe temperatures during transit.
• Delivery is handled by reputable carriers. Estimated delivery windows are shown at checkout but are not guaranteed due to weather, carrier delays, or other factors beyond our control.
• Risk of loss and title to the products pass to you upon delivery (or attempted delivery) to the address you provide.
• You must be available to receive the delivery or provide clear instructions (e.g., “leave at door”). If the package is left unattended as per your instructions, it is at your risk.
• Important – Perishable Goods: Inspect the package immediately upon receipt. Products must remain frozen or properly refrigerated. Transfer to your freezer right away. We are not responsible for spoilage after delivery.

6. Cancellations

• You may cancel an order before payment is received by contacting us immediately at admin@glengarrytraditions.ca or 1-888-825-4405.
• Once payment is received and processing has begun, cancellations are not accepted due to the perishable nature of the products.

7. Returns, Refunds, and Quality Guarantee

• No returns accepted. Due to the perishable nature of meat products and strict food-safety regulations (SFCR), we cannot accept returned items for restocking or resale.
• Quality Issues Only: If products arrive damaged, thawed, or otherwise defective through no fault of your handling:
  • Contact us within 24 hours of delivery at admin@glengarrytraditions.ca with your order number, photos of the issue, and packaging.
  • We will review on a case-by-case basis and may, at our sole discretion, offer a replacement, store credit, or refund of the affected items (including shipping).
• All other sales are final. This policy complies with Ontario’s Consumer Protection Act, 2002, and federal food-safety rules.

8. Product Handling, Safety, and Disclaimers

• You are solely responsible for proper storage, thawing, cooking, and consumption of all products. Always follow safe food-handling practices and use a food thermometer.
• We are not liable for any illness, injury, or damage resulting from improper handling, storage, or preparation after delivery.
• Products are provided “as is.” We disclaim all warranties, express or implied, to the fullest extent permitted by law, except as required by applicable consumer-protection legislation.
• We are not responsible for allergic reactions; check ingredient and allergen information carefully before ordering.

9. Limitation of Liability

• To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the specific products in question.
• We are not liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits or data).

10. Privacy

• Your personal information is handled in accordance with our separate Privacy Policy (available on the Site) and applicable law, including PIPEDA.

11. Intellectual Property

• All content on the Site (text, images, logos, including the Glengarry Traditions and Desautels Foods marks) is owned by us or our licensors and protected by copyright and trademark law. You may not reproduce or use it without prior written consent.

12. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
• Any disputes shall be resolved exclusively in the courts of Ontario located in Ottawa or the nearest applicable judicial district.

13. Miscellaneous

• If any provision is held invalid, the remainder remains in effect.
• These Terms constitute the entire agreement between you and us regarding your purchases.
• We reserve the right to refuse service, cancel orders, or terminate accounts for any reason, including suspected fraud or violation of these Terms.
